Terms of service

1. Purpose
These terms govern access to and use of the ConsentLift service (the "Service"), published by Gaston Media SAS (French Société par actions simplifiée (SAS), SIREN 884 076 027, registered office 18 rue de Copenhague, 67610 La Wantzenau, France). By subscribing to or using the Service, the customer (the "Customer") accepts these terms.
2. Service description
ConsentLift is an analytics platform that measures, in euros, the impact of the cookie-consent opt-in rate on the Customer's advertising revenue. The Service plugs on top of the Customer's existing CMP and does not replace it, nor the Customer's responsibility for collecting consent.
3. Account and access
Access to the Service requires an account. The Customer is responsible for the confidentiality of its credentials and for actions taken through its account. Gaston Media SAS may suspend access in case of use that does not comply with these terms.
4. Subscription and billing
Pricing, volume and term are defined in the order or quote accepted by the Customer. Unless otherwise stated, subscriptions are payable in advance and renew per period. Prices are exclusive of tax.
5. Data and privacy
Data processing is described in our privacy policy. Where Gaston Media SAS processes data on behalf of the Customer, a data processing agreement (DPA) applies. ConsentLift stores no personal data from the Customer's visitors (hashed identifiers, EU hosting).
6. Intellectual property
The Service, its code, interfaces and brand remain the exclusive property of Gaston Media SAS. The Customer retains ownership of its data and is granted a non-exclusive, non-transferable right of use for the duration of the subscription.
7. Availability and liability
Gaston Media SAS uses reasonable means to ensure the Service's availability. Revenue estimates are indicators based on documented assumptions and do not constitute a guarantee of results. Gaston Media SAS's liability is limited, to the extent permitted by law, to the amounts actually paid by the Customer over the preceding twelve months.
8. Term and termination
Either party may terminate the subscription under the conditions set out in the order. In the event of an uncured material breach, the other party may terminate by operation of law. Upon termination, the Customer may request the export or deletion of its data.
9. Governing law and jurisdiction
These terms are governed by French law. Any dispute falls under the exclusive jurisdiction of the courts of Strasbourg, France, failing amicable resolution.
